If you are going through a divorce, you most likely have a lot of questions. Ideally, you should be able to contact your lawyer with questions at any time, receiving a quick response with a satisfactory answer. Unfortunately, things don’t always work out that way. What should you do if your lawyer does not respond when you call or email them?

First, you need to address whether or not your expectations are realistic. Most lawyers have heavy caseloads. As a result, it may take them several days to get back to you with an answer. If it has only been a day or two and you still haven’t heard back, give them a little bit more time. They may have had something come up with another one of their cases that is keeping them from responding right away.

Dealing With Legal Issues

It is also important to remember that your lawyer is not there to be your therapist. They are there only to deal with any legal issues that directly relate to your divorce. If you are calling them to ask them about personal issues or to air out a list of your grievances against your spouse, they may decline to call you back, simply because those types of communications don’t fall under their job description. If you have a legitimate question that is related to your case, however, they should respond in a timely manner.

Another reason why a lawyer may not respond when you contact them is because they have already answered the question that you are asking. A lot of times, people ask their lawyers the same questions over and over again, simply because they weren’t happy with the answer that they got the first time around. If nothing has changed since the first time that your lawyer answered the question, they may decline to call you back, simply because it would be a waste of time to repeat the same information they gave you the first time.

Keep in mind, also, that a lawyer can only communicate directly with their client about a particular case. If a friend or family member contacts them on your behalf, from a legal standpoint, your lawyer can’t call them back to talk to them about your case.

Having said all of that, if you have a legitimate question that relates directly to your case that has not been answered before, your lawyer should respond within a few days. If they don’t, reach out to them again to make sure that they got your message the first time around. If they still don’t get back to you, consider writing a letter and sending it to them through certified mail, making sure to mention that you have contacted them a couple of times with a question and have not received a reply.

If they receive the letter and still don’t respond, you can then file a bar complaint against them. You should also stop using their services, looking for a different lawyer instead. You deserve to be treated with respect, which means that your lawyer should respond within a reasonable amount of time to any questions you may have about your case.
